Notification of the procedure for closing inactive bank accounts

Dear customers[1]!

«Freedom Bank Kazakhstan» JSC (hereinafter referred to as the Bank), taking this opportunity, expresses its respect and thanks you for your cooperation and for the trust you have placed in the Bank.

In accordance with paragraph 1 of Article 28 of the Law of the Republic of Kazakhstan «Payments and payment systems» (hereinafter referred to as the Law), closing of the bank account of the client is carried out according to the statement of the client or independently by bank, in cases of termination of or refusal to perform the bank account or bank deposit agreement, in accordance with the procedure provided for in Article 29 of the Law. According to subparagraph 1) of paragraph 1 of Article 29 of the Law, the bank has the right to refuse to perform the bank account or bank deposit agreement (close the bank account) in the event of the absence of funds in the clients bank account for more than 1 (one) year.

Clause 7 of Article 29 of the Law provides that if there is no money in the client’s bank account, the bank, after 3 (three) months from the date of notification of refusal to execute the bank account or bank deposit agreement, terminates the bank account or bank deposit agreement and closes the bank accounts.

Individuals:

In accordance with paragraph 4.23 of the General Terms and Conditions for Conducting Transactions, Opening, Maintaining and Closing Bank Accounts and Payment Cards of «Freedom Bank Kazakhstan» JSC

If there were no movements of funds on the Clients Account/Payment Card Account (with an expired Card) (except for transactions to withdraw the Banks commission for account maintenance) (if any) and/or there were no funds on such account for 1 (one) calendar year, the Bank shall notify the Client by any available method provided for in the General Terms and Conditions of the absence of funds and movement of funds on such account and of its closure upon expiration of 3 (three) months from the date of Notification. If within 3 (three) months from the date of the Notification the Client fails to resume operations on such account, the Bank shall unilaterally terminate and discontinue the relationship for servicing such account and close such account, with the exception of savings accounts, accounts intended for the crediting of benefits, social payments paid from the state budget and (or) the State Social Insurance Fund, or pensions paid from the state budget and (or) the unified accumulative pension fund, and (or) the voluntary accumulative pension fund, as well as alimony (money intended for the maintenance of minors and disabled adult children.

Subparagraph 4 of paragraph 11.1 of the General Terms and Conditions for Conducting Transactions, Opening, Maintaining and Closing Bank Accounts and Payment Cards of «Freedom Bank Kazakhstan» JSC provides for the Banks right to notify Clients by posting information in the media or at the Banks offices or by publishing it on the Banks official website on the Internet.

Legal entities and individual entrepreneurs2:

In accordance with paragraph 3.38 of the Standard Agreement for Comprehensive Banking Services for a Legal Entity, Individual Entrepreneur, Private Notary, Private Bailiff, Lawyer, Professional Mediator, Peasant (Farm) Enterprise, posted on the official website of «Freedom Bank Kazakhstan» JSC, the Bank has the right to close the account unilaterally if there has been no movement of funds on the Clients account and the balance has been more than one year.

In this regard, the Bank notifies you of the closure of bank accounts due to the absence of account movements, for which the balance is 0 (zero) for a period exceeding the last 12 (twelve) months and on which there will be no balance/movement of funds in the following 3 (three) months from the date of posting the Notification.

In this case, the commission for maintaining and closing current accounts is written off in accordance with the Banks tariffs.

In case of disagreement with the termination of business relations, we ask you to notify the Bank in writing or make a transfer transaction (i.e. payment and (or) transfer) on the current account or replenish the bank account/deposit.
